1. Introduction

1.1 The Agreement

These terms and conditions (“The Agreement”) state the rules and regulations governing the use of the OfficialBoxOffice.com website (“The Site”). The Agreement is between you (“You” or “Your”) and OfficialBoxOffice (“We” or “Us” or “Our”) and covers all aspects of buying or selling tickets on the The Site. By making use of any of the services on The Site you agree to adhere to every aspect of The Agreement.

1.2 The Service

OfficialBoxOffice offers a service to facilitate the buying and selling of tickets in a secure, safe environment (“The Service”). In order to use The Service you must register and become a member of OfficialBoxOffice. Members who wish to sell tickets will be referred to as “Sellers”, members who wish to buy tickets will be referred to as “Buyers”

1.3 Amendments

OfficialBoxOffice reserves the right to update or amend The Agreement at any time. These amendments will be automatically added to The Agreement on The Site. Your continued use of The Site and The Service constitutes your acceptance of these changes.

2. Getting Started

2.1 Members

In order to make use of The Service you must first register your details on The Site and become a member. You must accept all the terms of The Agreement and be legally entitled to enter into binding contracts. If you are under the age of 18, you must obtain your parents or guardians consent to cover the contract/agreement on your behalf.

2.2 Registration Details

When registering to become a member you must agree to enter your correct personal details including your real name, your home address , contact phone number and email address.

2.3 Password Security

When you register you will also be required to create a password. This password is the security on your account and should not be shared with any other party. You agree to not intentionally allow anyone access to your account. If you think your password has been compromised you must change it immediately. You are solely responsible for any actions carried out on The Site under your name.

3. Buyers

3.1 Search for tickets.

Enter the name of the event/artist you wish to buy tickets for in the Search box and search for tickets. If there are any tickets available, select the item you wish to purchase and proceed through the purchase process. If you are a member you will need to sign-in, if not you will be required to register.

3.2 Payment

You will be required to pay for your tickets using a valid debit or credit card, with the exception of AMEX and Diner’s Club. The full amount (including any VAT, booking fees and delivery charges) will be displayed on screen before you confirm the payment, there are no hidden charges. Once you confirm that you accept the charges you authorise us to take payment from your card immediately. Your order will not be complete until we receive authorisation on the payment from your bank.

3.3 Confirmation of Purchase

We will send you an email confirmation of your purchase. Details of your purchase will also be accessible from the My Account section of the site.

3.4 Fulfilment

Upon completion of the order, we will inform the Seller of the purchase. You authorise us to disclose your contact details to the Seller in order for them to despatch the tickets. It is then the responsibility of the Seller to ensure the Buyer receives the tickets at least five days before the start of the event. If you have not received your tickets 72 hours before the event you should inform us immediately and we will use our best endeavours to trace the whereabouts of your tickets and/or source suitable replacements.

3.5 Refunds

No refunds will be offered for changes to the event date/time/ line-up or partial performances. If the fault lies with the Seller (failure to deliver, counterfeit tickets, incorrect tickets) we will facilitate conversations between the Buyer and the Seller to end the dispute. Any illegal activity will be reported to the relevant authorities. If the event is cancelled we will process a refund onto the card you used to make the payment, less any booking fees you may have paid.

4. Sellers

4.1 Listing Tickets

Enter the name of the event/artist you wish to buy tickets for in the Search box and search for a listing on the site. Check the returned list for the event/artist. If the event/artist exists, you must ensure you select the correct venue and date, and proceed to the listing details page. If you are a member you will need to sign-in, if not you will be required to register.

4.2 Pricing

You must enter the price you wish to sell each individual ticket for. This is the price that we will charge the Buyer, out of which we will retain our Sellers fees (see below). Where possible we will let you know the face value of the ticket, but you can list your tickets at any price. The price can be altered at any time while the listing is active. However, once you have a confirmed buyer you will be unable to make any further changes and you are contractually bound to supply the tickets at this price.

4.2 Delivery Charges

You do not need to include any delivery charges in your pricing. We will handle all aspects of delivery on your behalf, including adding any necessary charges to your listing. We will supply you with a Sellers pack, which contains a pre-paid envelope to despatch your tickets.

4.3 Quantity

You must enter the number of tickets you wish to sell as a batch. We do not let the Buyer choose how many tickets they wish to buy. For example, if you have four tickets and you wish to sell them as singles, you must create four separate listings with a quantity of one. However, if you wish to sell them as a pair, you must create two separate listings with a quantity of two.

4.4 Notes

We include an optional Notes section on listing for you to enter any special details about the tickets you are selling. You must use this section to inform customers anything that could later be used to dispute the validity of the listing. This includes but is not limited to:

A group of reserved seats that are not together

Reserved seats with restricted views

Tickets for a specific area that is not covered by the description

4.5 Reserved Seating

If you are selling tickets for seats in a reserved area we will provide a section during the creation of the listing where you must enter the individual Block, Row and Seat number for each ticket in the listing. If you are selling a group of tickets that are not together, this should be stated in the Notes section on your listing (see above).

4.6 Sellers Fees

We do not charge anything to for you to create a listing on the site. We will only take payment upon the successful completion of a sale through the site. This payment will be in the form of a percentage of the price you listed you tickets for. The exact fees will be displayed when you create your listing. By confirming and posting the listing on the site you authorise us to retain this percentage before making any payments to you.

4.7 Confirmation of Sale

We will send you an email confirmation to let you know when you have made a sale. Details of your sale will also be accessible from the My Account section of the site.

4.8 Fulfilment

Upon successful completion of a sale we will send you a Sellers pack. This will contain all the details you need to send your tickets to the Buyer, including a pre-paid envelope. You agree not to insert any additional unauthorised promotional material into the envelope. It is your responsibility to ensure that the tickets are sent to the Buyer no later than five days before the event. If this despatch date cannot be achieved you will be in breach of contract and we reserve the right to withhold payment for that order. The only authorised method of delivery is via the pre-paid envelope, you agree not to contact the seller to arrange any alternative method of delivery (including, but not limited to, hand delivery, collection at the venue, other postal methods).

You agree not to contact the seller for any reason not related to this particular sale of tickets. Upon successful despatch of the tickets you agree to destroy the contact details for the buyer.

4.9 Seller Payments

In order to protect against fraudulent activity, we will not make any payments to the Seller until at least 48 hours after the completion of the event. If there are no disputes raised by the Buyer we will contact the Seller to make payment . You must agree to provide us with a valid credit/debit card number into which we will make the payment. It is your responsibility to ensure the card details you supply are correct.

4.10 Cancellations

If the event is cancelled, you agree that the contract between you and the buyer is null and void. We will refund the Buyer and will not make any payments to the Seller.

4.10 Seller Commitments

As the Seller, it is your responsibility to ensure you create an accurate truthful listing. You must guarantee that you will supply the exact tickets listed at the price stated upon successful confirmation of sale. Once the listing has been created you grant us absolute authority to display the listing on our site and/or any partner/affiliate sites. You are solely responsible for any tax that may be payable on sales made through the site.

5. General Behaviour

5.1 Rules of Conduct

You agree to follow the terms set out in this Agreement and will only use the service as it is intended. You will not a) supply false information, b) sell counterfeit, fraudulent or stolen tickets, c) use the service to post lewd, racist, sexist information or information that is defamatory or derisory in any way.

5.2 Retribution

You authorise us to conduct an in-depth investigation into any complaints received about you or any suspicious activity. You agree to co-operate fully and comply with any direct enquiries that may arise from the investigation.

We reserve the right to suspend all member activity while investigations are being carried out.

If any deliberate violations of this Agreement are discovered the member account will be terminated immediately. All active listings associated with that member will be deleted and any outstanding funds returned to the buyer. Any suspected illegal activity will be reported to the appropriate authorities.

6. Legal Compliance

6.1 Using the Service

This Agreement has been written in accordance with the laws of England and Wales. By using the service you must adhere to the laws of the land and consent to be governed by the authority of the English courts.

You also guarantee that you will comply with any additional applicable international laws and the laws of your country of residence.

6.2 Data Protection

The data we hold about you will only be used for the specific purposes related to the buying and selling of tickets on the site, as stated in this Agreement. We will not use or disclose your data in any other way without your written consent, unless requested by law.

6.3 Liability

You agree that we are not liable for any disputes that arise due to misrepresentation of the tickets for sale on the site. This includes, but is not limited to, failure to deliver, counterfeit or fraudulent tickets, sale of stolen goods, incorrect seats, etc. You agree that we are not liable for any claims arising due to lost or stolen tickets, you missing the event for any reason, any changes to the date, time venue or line-up.

6.4 Disclaimer

We offer no guarantees with regards to the availability or usability of the site. The site and service are offered on a What You See Is What You Get basis. We disclaim any liability for losses incurred due to the availability or usability of the site.
